Terms of Service

1. Acceptance of Terms

By accessing or using CardioHelper ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. The Service is operated by Dr. Zbigniew Bociąga ("we", "us", "our").

2. Description of Service

CardioHelper is an informational clinical decision support tool that synthesizes published cardiology guideline content from ESC, ACC/AHA, and other recognized bodies. The Service provides structured recommendations with source citations, drug dosing information, and safety validation.

3. Eligibility

The Service is intended for licensed healthcare professionals. By using CardioHelper, you represent that you are a qualified medical professional authorized to make clinical decisions in your jurisdiction. The Service is not intended for use by patients or the general public.

4. Not a Medical Device

CardioHelper is not classified as a medical device under EU Medical Device Regulation (MDR 2017/745) or FDA regulations. It does not:

  • Diagnose, treat, cure, or prevent any disease
  • Provide patient-specific treatment recommendations
  • Replace clinical judgment or physician decision-making
  • Interpret diagnostic tests or imaging

No CE marking or FDA clearance is required or claimed.

5. Clinical Responsibility

All clinical decisions remain the sole responsibility of the treating physician.CardioHelper provides information derived from published guidelines to assist — not replace — your professional judgment. You must:

  • Verify all recommendations against current local Summary of Product Characteristics (SmPC)
  • Consider the individual patient's clinical context, comorbidities, and preferences
  • Follow your institution's clinical protocols and governance requirements
  • Exercise independent professional judgment for every clinical decision

6. Accuracy and Limitations

We strive for accuracy and update guideline content within 4 weeks of new publications. However, we do not guarantee that information is complete, current, or error-free. Guideline recommendations may change, and regional variations in approved indications, dosing, and contraindications exist. Always verify against the latest guideline text and local SmPC.

When CardioHelper cannot find sufficient guideline consensus for a query, it returns a "NO CONSENSUS" response with suggested next steps rather than generating a potentially inaccurate answer.

7. Accounts and Billing

  • You are responsible for maintaining the security of your account credentials
  • Paid subscriptions are billed monthly or annually as selected
  • You may cancel at any time — access continues until the end of the current billing period
  • No refunds for partial billing periods, except as required by applicable law
  • Unused queries do not roll over between billing periods
  • Prices are in EUR and exclusive of applicable VAT

8. Acceptable Use

You agree not to:

  • Share your account credentials or allow unauthorized access
  • Use the Service to provide direct patient-facing advice without physician intermediation
  • Attempt to reverse-engineer, scrape, or systematically extract content from the Service
  • Use the Service in violation of applicable laws or professional regulations
  • Represent CardioHelper output as your own original guideline analysis without attribution

9. Intellectual Property

CardioHelper is not affiliated with, endorsed by, or sponsored by ESC, ACC, AHA, or any other guideline-publishing organization. Guideline content referenced in our responses is attributed to its original source. The CardioHelper software, interface, and proprietary synthesis methodology are owned by us.

10. Limitation of Liability

To the maximum extent permitted by law, CardioHelper and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service. Our total aggregate liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

Clinical outcomes are the responsibility of the treating physician. We provide information to support — not replace — clinical decision-making.

11. Governing Law

These Terms are governed by the laws of the Republic of Poland. Any disputes shall be submitted to the competent courts in Poland. For EU consumers, mandatory consumer protection provisions of your country of residence apply.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email to registered users at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance.
